Section 1

Agreement to Terms

By accessing or using wetherapy (“we.,” “the Service,” “the Platform”), available at wetherapy.io, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you”) and wetherapy (“we,” “us,” “our”). By creating an account or uploading content, you confirm that you have read, understood, and accepted these Terms.

Section 2

Experimental Status

wetherapy is currently in an experimental state. The Service is provided as an early-access product under active development. By using the Service, you acknowledge and agree to the following:

The Platform is not a finished product. Features, interfaces, and functionality may change, break, or be removed without notice.

Uptime, reliability, and data availability are not guaranteed during this experimental phase.

While we take every reasonable precaution to protect your data (see Section 6), we cannot guarantee against data loss, corruption, or service interruptions inherent to experimental software.

The Service should not be relied upon as a sole record of your therapy sessions, insights, or personal data. You are encouraged to maintain your own copies of any content that is important to you.

We reserve the right to discontinue or fundamentally alter the Service at any time during the experimental period, with reasonable notice provided to active users.

We will communicate material changes to functionality or data handling practices through the email address associated with your account.

This experimental status does not diminish our commitment to your privacy and data security. The privacy architecture described in these Terms and on our Privacy page is foundational—not aspirational.

Section 3

Description of the Service

wetherapy is a therapy companion platform. You upload recordings of your therapy or coaching sessions—audio, video, or transcript—and the Service uses artificial intelligence to identify patterns, themes, insights, and meaningful moments. These insights are returned to you so you can reflect on and revisit them between sessions.

wetherapy is not a therapy provider, mental health service, or medical device. The Service does not diagnose, treat, or provide clinical recommendations. It is a reflective tool designed to complement—never replace—the work you do with a licensed professional.

Section 4

Eligibility

You must be at least 18 years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

Section 5

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to or use of your account.

You may only create one account per person. Accounts are non-transferable.

Section 6

Privacy, Data Handling & the Discovery-Proof Model

Your therapy sessions represent some of the most sensitive information you could ever share. Our technical architecture is built around this reality.

6.1  Discovery-Proof Architecture

wetherapy follows a discovery-proof privacy model, inspired by Signal's approach to private communication. This means:

Minimal data collection. We collect only the information strictly necessary to operate the Service — your account credentials and the insights derived from your sessions.

No social graph. We do not build, infer, or store relationship maps between users, therapists, or any other parties.

No behavioral profiling. We do not track, profile, or analyze your behavior across sessions for purposes other than delivering your insights.

No discoverability. Your use of wetherapy is not discoverable by other users, therapists, or third parties through the Platform unless you explicitly choose to share.

6.2  How Your Data Flows

Upload

Your file is encrypted in transit (TLS 1.3) and at rest (AES-256). Each user has isolated storage — your files are never mingled with anyone else’s.

Processing

Your session is processed in an isolated container, separate from every other user and not shared with any other company. When analysis is complete, that container is destroyed.

Retention

The raw recording is deleted after processing. Only the derived insights, timestamps, and patterns are retained.

Deletion

You can delete everything at any time. When you do, we destroy your encryption keys — the data becomes cryptographically unreadable. You can also set auto-delete rules: delete after 30 days, after 90 days, or keep until you say otherwise.

6.3  Zero-Knowledge Encryption

wetherapy uses a zero-knowledge encryption architecture. This means we are unable to access the contents of your sessions or insights, even if compelled to do so. Your data is encrypted with keys that only you control.

Your data is protected by zero-knowledge encryption, AES-256 encryption at rest, TLS 1.3 in transit, strict role-based access controls, and audit logging. Because of the zero-knowledge architecture, we do not have the technical ability to read your session content or insights—not if we wanted to, and not if we were compelled to.

6.4  What We Will Never Do

We will never sell your data.

We will never use your sessions to train AI models — and neither will anyone else. Your data stays in isolated containers, is never shared with AI providers for training, and is destroyed after processing. This is not a policy. It is architecture.

We will never share your content with your therapist without your explicit consent.

We will never show you ads.

We will never make it hard to leave. Export or delete your data, anytime.

Section 7

User Content & Ownership

7.1  Your Content

You retain full ownership of all content you upload to the Service (“User Content”), including session recordings, transcripts, notes, and any other materials. We do not claim any ownership interest in your User Content.

7.2  Limited License

By uploading content, you grant us a limited, non-exclusive, non-transferable license to process your User Content solely for the purpose of providing the Service to you—generating insights, identifying patterns, and delivering your results. This license terminates immediately upon deletion of your content or your account.

7.3  Responsibility for Content

You are solely responsible for your User Content. You represent that you have all necessary rights and permissions to upload the content you provide. If your sessions involve other participants (such as a therapist), you represent that you have obtained any required consent from those participants before uploading.

Important: Laws regarding the recording of conversations vary by jurisdiction. Some jurisdictions require all parties to consent to being recorded. It is your responsibility to understand and comply with the laws that apply to you.

Section 8

Therapist and Provider Sharing

If you choose to share insights or session data with a therapist or other provider through the Platform, you do so voluntarily. You control what is shared and can revoke access at any time. We act only as a conduit for sharing that you have explicitly authorized.

Section 9

Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.

Upload content that you do not have the right to share.

Attempt to gain unauthorized access to the Service, other users’ accounts, or our systems.

Reverse engineer, decompile, or disassemble any aspect of the Service.

Use the Service to develop a competing product or service.

Interfere with or disrupt the integrity or performance of the Service.

Use automated systems (bots, scrapers, etc.) to access the Service without our prior written consent.

Section 10

AI Processing & Third-Party Providers

The Service uses artificial intelligence to analyze your sessions and generate insights. You acknowledge and agree to the following:

AI-generated insights are not clinical advice, diagnoses, or treatment recommendations. They are reflective tools intended to support your therapeutic journey.

AI analysis may not be perfectly accurate. Insights may miss nuance, misinterpret context, or omit important themes. Always rely on your therapist or licensed professional for clinical guidance.

We use third-party AI infrastructure providers to process your sessions. These providers are contractually prohibited from using your data for training, and your data is processed in isolated containers that are destroyed after analysis.

We select providers that meet our security and privacy standards, but we cannot guarantee the actions of third parties beyond our contractual agreements with them.

Section 11

HIPAA & Health Information

wetherapy exceeds HIPAA requirements for privacy and security. All data is encrypted at rest and in transit, access is strictly controlled and audited, and we maintain the technical safeguards required for protected health information.

However, because the Service is in an experimental state, we do not currently represent ourselves as a HIPAA-covered entity or business associate. If you require a formal Business Associate Agreement (BAA), please contact us directly.

Section 12

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Without limiting the foregoing:

We do not warrant that the Service will be uninterrupted, error-free, or secure, particularly during the experimental phase.

We do not warrant the accuracy, completeness, or usefulness of any AI-generated insights.

We do not warrant that the Service is suitable for any particular clinical, diagnostic, or therapeutic purpose.

We are not a healthcare provider. The Service does not constitute medical advice, therapy, counseling, or any form of clinical care.

We are not responsible for any decisions you make based on insights generated by the Service.

Section 13

Limitation of Liability

To the maximum extent permitted by applicable law, wetherapy and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, emotional distress, or damages arising from your use of or inability to use the Service.

Our total aggregate liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

This limitation applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Section 14

Indemnification

You agree to indemnify, defend, and hold harmless wetherapy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any rights of another party.

Section 15

Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. Given the experimental nature of the Service, changes may be frequent. We will make reasonable efforts to notify you of material changes through the email associated with your account.

Section 16

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. If we make material changes, we will notify you via the email address associated with your account or through a prominent notice within the Service.

Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and delete your account.

Section 17

Termination

You may terminate your account at any time by deleting your account through the Service. Upon termination, we will destroy your encryption keys, rendering your data cryptographically unreadable.

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. If we terminate your account without cause, we will provide you with reasonable notice and an opportunity to export your data.

Section 18

Data Portability & Exit

We believe you should never be locked in. You have the right to:

Export your insights and data at any time.

Delete all of your data at any time, with cryptographic assurance of destruction.

If wetherapy shuts down, we will provide advance notice and a data portability plan so you can retrieve your information before the Service is discontinued.

Section 19

Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.

Section 20

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Section 21

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and wetherapy regarding the Service and supersede all prior agreements, understandings, and communications.
